Balkin, "The New Originalism and the Uses of History"

Jack M. Balkin (Yale Law School) has posted "The New Originalism and the Uses of History." It is forthcoming in the Fordham Law Review. The abstract reads:
Central to the New Originalism is the distinction between constitutional interpretation and constitutional construction. Interpretation tries to figure out the Constitution's original communicative content, while construction builds out doctrines, institutions and practices over time. Most of the work of constitutional lawyers and judges is constitutional construction.

The distinction between interpretation and construction has important consequences for constitutional theory. In particular, it has important consequences for longstanding debates about how lawyers use history and should use history.

First, construction, not interpretation, is the central case of constitutional argument, and most historical argument occurs in the construction zone.

Second, although people often associate historical argument with originalist argument, the actual practices of lawyers and judges demonstrate that non-adoption history is as important as adoption history to constitutional construction.

The Catford Bridge Tavern bought by Camden pubco

Pubco Antic has lost its fight to hang on to The Catford Bridge Tavern, a pub the team brought back from the brink and then fought their landlords to prevent it becoming retail. They announced on Twitter:

It is with very heavy heart that we must announce we are closing @catfordtavern. We are all absolutely gutted. Such a huge shame. I guess it's the danger of creating such a fantastic pub. It's all down to the type of lease. Unfortunately these things do happen.

But the good news is that the drinkers of Catford can welcome their new Camden overlords, since the pub has been bought by Camden Bars, the pubco behind the Lock Tavern, which was once twinned with the Amersham Arms in New Cross.

Hopefully, this might spur Antic to refocus their attention on reopening Jam Circus, which languishes up the road in Crofton Park, still scarred by smoke and fire.

Thanks to Matt and Monkeyboy for the spot.

The Geography of Intergenerational Mobility

A team of top academic economists recently released the results of their study of the economic impact of tax expenditures on intergenerational mobility.  Raj Chetty (Harvard University), Nathaniel Hendren (Harvard University), Patrick Kline (University of California Berkeley), and Emmanuel Saez (University of California Berkeley) compiled millions of anonymous earnings records into a larger and richer dataset than previously available, which allowed them to construct measures of relative and absolute mobility for 741 commuting zones (derived from Census data, commuting zones are geographical aggregations of counties based on commuting patterns) in the US.  Their analyses reveal substantial variation in mobility across areas--variation that appears unrelated to differences in cost of living, race, or economic growth.

To look up statistics for a specific city or area, use the interactive version of these maps created by the New York Times.

To understand the drivers of this variation, the researchers examined the impact of tax expenditures, as well as other factors.  Their findings suggest that tax policies account for some of the variation in outcomes across areas (local tax rates having more impact than state Earned Income Tax Credit policies) but other factors may be equally as important.  Among those, income inequality, economic and residential segregation, and prevalence of children raised by single parents were negatively correlated with intergenerational mobility, while K-12 school quality and social capital were positively associated with mobility.

The researchers caution against interpreting these findings as causal effects, explaining that areas with these characteristics "may also have other differences that could be the root cause driving the differences in children's outcomes."  What the study does show is that "[t]here is substantial variation in the United States in the prospects for escaping poverty.  There are some areas [...] where a child's chances of success do not depend heavily on his or her parents' income."

Lewisham Hospital saved

Amazing, wonderful news. Lawyers acting for the campaign to save Lewisham Hospital from the threat the closure of key services say:

The High Court today (31 July 2013) found that the Secretary of State for Health, Jeremy Hunt MP, had acted outside his powers and therefore unlawfully, in deciding to substantially cut services and close departments at Lewisham Hospital.

In today’s judgment Mr Justice Silber said that the decision of the Secretary of State must be “quashed” as he had acted outside his powers as Secretary of State, and in breach of the National Health Service Act 2006, when he announced to Parliament that services at Lewisham Hospital would be downgraded and closed.

The BBC reports:

The judge gave [Hunt] permission to appeal against the decision. Mr Justice Silber said recommendations of the Secretary of State had to have regard to, or be supported by, GP commissioners. It was quite clear that the Lewisham GP commissioners did not give support to the proposals, said the judge.

He went on: "On the contrary, they strongly opposed them although those GP commissioners in a number of surrounding but different areas were happy with them. I considered that it was the absence of support from the local GP commissioners which constituted an additional reason why the decision of the Secretary of State cannot stand."

Staircase nook

Hey hey all! Well, it’s about that time! I’m off to Atlanta today to prepare for the Haven Conference that starts tomorrow. It’s been a year of planning and I can’t even believe it’s already here! SO excited to see everybody.

So I finished up a quick little project this week that I’ve been meaning to do for months. Or a year. A year and a few months.

We have a little ledge/nook/cut out spot in the basement staircase that has been sitting half way done for that year and a few months:

You may remember that I installed a wood wall on the main wall in the staircase about this time last year. I still LOVE that wall. So very much.

Before we had the basement finished the wall next to it going down the steps had a weird cement wall bump out thing. Instead of drywalling all the way up I asked them to make it a little ledge instead. They installed a wood piece that I was planning on painting later, hence the stain spatter I didn’t worry about:

But since then I’ve decided I wanted it stained instead. I’m kind of obsessed with the look of the dark wood against the gray blue walls (Marina Gray by Ben Moore) and white trim down there.

So I needed to sand off that stamp and the stain dots:

sanding before staining

It just took a few seconds and I was ready to go – then I taped everything off with my Frogtape really well. I find it’s hard to keep stain from going everywhere since it leaks easily and spatters all over the place. (It could be the operator, who knows.):

prepping for stain

After I wiped everything down well (and let it dry), I grabbed my dark walnut stain and went at it:

how to stain

Remember when you stain to work quickly and to keep the “wet edge” – if it dries at all during the process you’ll see where you left off. OH, and wear gloves!! Trust me – no matter how hard I try I always end up with stain on my hands.

I let it sit for a few minutes and wiped the excess off. I only usually do one coat – I find that’s plenty for the color I want.

While it dried I started hanging the frames I’ve had leaning there forever. Most of them are pics from the Macy’s Thanksgiving parade/NYC trip I showed you here, but there was one collage my stepdaughter gave us last Christmas (so sweet!) that I wanted to include too.

Here’s a little tip when hanging pics that have two hangers instead of one – just tie a piece of string or wire between the two:

hanging picture without a level

Then hang that on the the nail. SO much easier. I mean, sometimes what you’re hanging is heavy enough you’ll want two nails, but most of the time I find one is just fine. And this way you don’t have to worry about measuring, finding a level, all that stuff. Ain’t nobody got time for that.

Like all of my gallery walls, I just kind of put stuff here and there – yes, that meant a few extra holes in the wall but they’re tiny. The wall will survive:

matching frames gallery wall

I was trying to use frames that I had on hand and I liked the (mostly) matching frames, so I didn’t go crazy trying to fill empty spaces. The “S” we’ve had for years and it perfectly filled one spot that was bugging me.

The ledge has plenty of room for accessories, but for now I just left a couple candlesticks we had here before (they ended up on there because I was too lazy to take them all the way to the storage room):

matching frames gallery wall

They are fake candles and they operate on a timer, so it’s kind of cool to have that little glow as we walk down at night.

It was a quick project and I think it turned out pretty cute! I love how it looks with the planked wall:

wood planked wall

Next up in this space – touch up the wall and ceiling paint and install chunkier baseboards. Maybe I’ll tackle those in another year. Baby steps.

So are you loving gallery walls? I am and I don’t think they’re going anywhere soon. It’s such a personal, easy way to fill wall space! And remember you can find frames at Goodwill for super cheap and spray paint them. One color for all of them will unify frames no matter their design.

Lyrics: Juventa & Karanda ft. Roxanne Barton - Ethereal

Ethereal
Juventa & Karanda ft. Roxanne Barton

You say one thing
But you do another
I still don't understand
Why won't you be my lover

A little too much romance
We're moving along too fast
Why won't you give it just one chance

Seconds with you are ethereal
Too perfect for this world
Let's stay like this forever
Just a boy and a girl

Seconds with you are ethereal
You're tearing down my walls
I'm here without my defenses
I'm feeling naked, so naked as I fall

New Release: Olivas, "Suing Alma Mater"

New from the Johns Hopkins University Press: Suing Alma Mater: Higher Education and the Courts, by Michael A. Olivas (University of Houston Law Center). Here's a description from the Press:
Although much has been written about U.S. Supreme Court decisions involving higher education, little has been said about the foundational case law and litigation patterns emerging from the lower courts. As universities become increasingly legislated, regulated, and litigious, campuses have become testing grounds for a host of constitutional challenges. From faculty and student free speech to race- or religion-based admissions policies, Suing Alma Mater describes the key issues at play in higher education law.

Eminent legal scholar Michael A. Olivas considers higher education litigation in the latter half of the twentieth century and the rise of "purposive organizations," like the American Civil Liberties Union and the Alliance Defense Fund (now known as the Alliance Defending Freedom), that exist to advance litigation. He reviews more than 120 college cases brought before the Supreme Court in the past fifty years and then discusses six key cases in depth. Suing Alma Mater provides a clear-eyed perspective on the legal issues facing higher education today.

Lyrics: Mischa Daniels ft. Sharon Doorson - Can't Live Without You

Can't Live Without You
Mischa Daniels ft. Sharon Doorson

I can't live without you
So won't you stay for another night
I can't live without you
So let me hold you and make light

The fire in your eyes
Tonight it lit my skies
I can't live without you

I'm so alone I'm breaking down
I'm begging you to stay around

I'm crying out for love, crying out for you
‘Cause I want you in my arms tonight
Does it leave you cold that I'm on my knees?
I'm begging you to make things right

I can't live without you
So won't you stay for another night
I can't live without you
So let me hold you and make light

The fire in your eyes
Tonight it lit my skies
I can't live without you

There's nothing that I wouldn't do
To spend the night alone with you

You've given up on love, given up on me
Given up on everything, baby
Does it leave you cold that I'm on my knees?
I'm begging you to stay with me

I can't live without you
So won't you stay for another night
I can't live without you
So let me hold you and make light

The fire in your eyes
Tonight it lit my skies
I can't live without you

Boyd on "Zoning for Apartments"

Marie Boyd (University of South Carolina School of Law) has posted "Zoning for Apartments: A Study of the Role of Law in the Control of Apartment Houses in New Haven, Connecticut 1912-1932." The article is forthcoming in Volume 33 of the Pace Law Review. Here's the abstract:
This article seeks to contribute to the legal and policy debates over zoning by providing a more detailed examination of the impact of apartments on both pre-zoning land use patterns and the zoning process during the formative initial stages of zoning in the United States than has been provided in the literature to date. Specifically, this Article analyzes the impact of apartments on both pre-zoning land use patterns and the zoning process in New Haven, Connecticut. It focuses on the period beginning with the selection of New Haven’s first Zoning Commission in 1922, and concluding with the passage of New Haven’s first zoning ordinance in 1926. Through this detailed historical account of the realities of zoning, this Article demonstrates how — due to delays in the enactment of zoning — New Haven’s first zoning ordinance, rather than shaping the future growth of the regulated area, was instead shaped by existing land use patterns and political considerations.

Southern-Style Green Beans – Slow Beans for Fast Times

One of the sadder side effects of the American culinary renaissance we’ve enjoyed over the last thirty or forty years, has been the chronic under-cooking of green vegetables. Sure, there was a time when we cooked everything too long, but now, if it’s not bright green and still crispy, it’s considered ruined.

That’s why every once and a while you have to enjoy something like these slow-cooked, southern-style green beans. These beans are cooked forever in a bacon-spiked, aromatic broth, and when they’re finally done, you’re almost shocked at how good they are. It seems so wrong, yet tastes so right.

I think two hours is perfect, but if your beans are fatter/thinner, you’ll have to adjust the time. What you’re looking for is something that literally melts in your mouth. Vibrant, quickly blanched green beans are many things, but “melt in your mouth” isn’t one of them. I hope you give these a try soon. Enjoy!

Ingredients for 6 portions:
2 pounds green beans, trimmed
1 handful sliced bacon (6 oz)
1 sliced onion
3 cloves garlic, minced
1/4 cup tomato sauce
3 cups chicken broth
salt, pepper, and cayenne to taste

Hyde on Law and Architecture in Prerevolutionary Cuba

Timothy Hyde, an Associate Professor of Architecture in Harvard University’s Graduate School of Design, has just published Constitutional Modernism: How Architecture, Law, and Urbanism Shaped the Premises of Civil Society in Cuba.  The publisher, the University of Minnesota Press, explains:
Constitutional Modernism explores architecture, planning, and law as cultural forces, analyzing the complex entanglements between these disciplines in the Cuban Republic. Timothy Hyde reveals how architects joined with other professionals and intellectuals in efforts to establish a stable civil society, from the promulgation of a new Cuban Constitution in 1940 up until the Cuban Revolution.
Roberto González Echevarría, Yale University, blurbs:
This is a major book on Cuba. It is the best history of modern Havana ever written, unlikely to be surpassed. Timothy Hyde is a thorough, scrupulous historian with a sophisticated grasp of architectural history and theory, as well as of the political and artistic history of Cuba. He chronicles in dramatic detail the vigorous debates around the question of cubanidad that led to the proclamation of the 1940 constitution, and to the formulation and execution of plans for the development of Havana: its plazas, boulevards, public buildings, and monuments. These deliberations, which included prominent intellectuals such as Fernando Ortiz and Jorge Mañach, came to an end with the advent of Castro’s regime.

Brockley immortalised

Simone writes:

Being a massive fan of Brockley and an artist, I've made some postcards of my favourite local landmarks (Carpet Corner I know is a strange choice of landmark but it makes me happy) and was wondering if you'd be interested in doing a shout out about these packs? I'm hoping to persuade some local shops to stock them.

These came about because ten year ago some pals and I did a billboard campaign called 'Happiness in Brockley' and one of the posters had my rabbit Fluffy and his Dad on Endwell Rd. This is a kind of a follow on from that image (in Brockley).

Americans Regard Military Highly

The Pew Forum on Religion and Public Life reports that the American public’s esteem for the Military is high. The findings are based on a survey of 4,006 adults via telephone interviews conducted March 21-April 8, 2013. The report further explains the findings:

Americans report that they continue to hold the military in high regard, with more than three-quarters of U.S. adults (78%) saying that members of the armed services contribute “a lot” to society’s well-being. That’s a modest decline from 84% four years ago, the last time the Pew Research Center asked the public to rate various professions. But the military still tops the list of 10 occupational groups, followed closely by teachers, medical doctors, scientists and engineers. A solid majority of the public says each of those occupations contributes a lot to society.

Whites are somewhat more likely than either Blacks or Hispanics to say members of the military contribute a lot to society. And Republicans and independents who lean toward the Republican Party are somewhat more likely than Democrats and independents who lean toward the Democratic Party to see the military as contributing a lot to society.

Organizational Strength Through Diversification

By Virgil Carter
With the emerging indications of economic strengthening, it may be time for CEOs, staff and volunteer leaders to do a quick check on the strength of their organizations.  Is your organization economically strong?  Do you have the protection and advantage of economic diversification?

A recent Strategy+Business article, “A Continuous Quest for Economic Balance”, by Richard Shediac, Chadi N. Moujaes and Mazen Ramsay Najjar, focuses on the important economic diversification of countries.  Much of what they write has equal application to the strength and well-being of many of our non-profit organizations.

For example, the authors write “Countries can be over-concentrated in any number of ways—for example, relying too heavily on large companies, exports, or foreign investment—and even countries that appear extremely diversified may still be vulnerable to unexpected events.”  How applicable is this to your organization?

A quick check of your annual budget will reveal the sources of your revenues.  If your major source of revenue accounts for more than about 35% of total revenues, you may question whether or not there is sufficient diversification (and protection) for your organization’s well-being.  If a single source of revenue counts for the majority of your revenue flow (over 50%) your organization may be at substantial risk in the event of disruption to the source of revenue.  Risk may be reduced and economic strength will be gained through economic diversification.

How to achieve strength through improved economic balance?  Certainly, continuing to support the elements that are at the center of an organization’s financial strength is obvious.  The answer for successful diversification is not simple.  And it is not achieved in a single step.  Diversification is a continuous, never-ending journey.  Perhaps the most successful journey is one that looks to increase the return of other key existing revenue sources, while also looking for new opportunities that are consistent with the mission of the organization.  Innovation and entrepreneurial efforts are a key in this regard.

For many non-profit organizations, economic strength through diversification is not easy.  No organization can be successful, however, without economic strength.  And if a conscious effort for needed diversification isn’t made, economic strength will never be achieved.   Is your economic balance where you’d like it to be?

The most important message for Japan is that the overall level of prices associated with GDP is back to 1980 and the long term fall will continue into the next few decades.

We have already mentioned that Japan is the best illustration of our concept linking inflation/unemployment to the change in labour force. In our previous post on the GDP deflator in Japan in 2011, we showed two cumulative curves for observed and predicted inflation since 1980. Here we add two more readings in both curves and conclude that our concept is quantitatively excellent. It gives an extremely accurate long term equilibrium relation between the GDP deflator, DGDP, and labour force. The underlying data have been borrowed from the OECD and Japan Statistics.

The most important message for Japan is that the overall level of prices associated with GDP is back to 1980 and the long term fall will continue into the next few decades.

By trial-and-error, we seek for the best-fit coefficients in the linear and lagged link between inflation and labour force. Because of the structural (measurement related) break in the 1980s, we have chosen the period after 1981 for linear regression, which is common for almost all economic studies related to Japan. By varying the lag and coefficients we have found the following relationship:

p(t) = 1.9dLF(t-t0)/LF(t-t0) – 0.0084         (1)

where the time lag t0=0 years; Figure 1 depicts this best-fit case. There is no time lag between the inflation series and the labour force change series in Japan. Free term in (1), defining the level of price inflation in the absence of labour force change, is close to zero but negative.

A more precise and reliable representation of the observed and predicted inflation consists in the comparison of cumulative curves shown in the lower panel of Figure 1. We always stress that the cumulative values of price inflation and the change in labour force are the levels of price and labour force, respectively. Therefore, the summation of the annual reading gives the original estimates of price and workforce, which when are converted into rates.

Another advantage of the cumulative curves is that all short-term oscillations and uncorrelated noise in data as induced by inaccurate measurements and the inevitable bias in all definitions are effectively smoothed out. Any actual deviation between these two cumulative curves persists in time if measured values are not matched by the defining relationship. The predicted cumulative values are very sensitive to free term in (1).

For Japan, the DGDP cumulative curves are characterized by very complex and unusual for economics shapes. There was a period of intensive inflation growth and a long deflationary period. The labour force change, defining the predicted inflation curve, follows all the turns in the measured cumulative inflation with the coefficient of determination R2=0.97 (R2=0.77 for the annual estimates). (Again, these are actually measured curves.) With shrinking population, and thus, labour force, the GDP deflator will be falling through 2050 and likely beyond.

Figure 1. Measured GDP deflator and that predicted from the change rate of labour force in Japan. Upper panel:  Annual curves smoothed with MA(3). Lower panel: Cumulative curves between 1981 and 2012. The extremely accurate agreement between the cumulative curves illustrates the predictive power of our model.

Lewisham's green spaces in top 10 nation-wide

Lewisham has won 14 Green Flag Awards from Keep Britain Tidy, giving it the joint-seventh-highest score for local authorities nationally. Green Flags are awarded based on criteria including cleanliness, management and safety.

Lewisham borough picked up 13 Green Flags for its outstanding parks, including Hilly Fields, Ladywell Fields and Telegraph Hill Park while Horniman Gardens, which is managed by the Museum Trust, also collected an award.

Lewisham also retained several Green Flag Community Awards (formally the Green Pennant Award) and picked up a new one for Frendsbury Gardens, the West Brockley park that was transformed in 2008.

Councillor Susan Wise, Cabinet Member for Customer Services, said: “I’m especially pleased that Frendsbury Gardens has received an award. As one of our newer open spaces, it’s a great example of how a community, supported by the Big Lottery fund, has turned around a disused space into something which is now award-winning.”

New Release: Murphy, "Citizenship and the Origins of Women's History in the United States"

New from the University of Pennsylvania Press: Citizenship and the Origins of Women's History in the United States, by Teresa Anne Murphy (George Washington University). Here's a description from the Press:

Women's history emerged as a genre in the waning years of the eighteenth century, a period during which concepts of nationhood and a sense of belonging expanded throughout European nations and the young American republic. Early women's histories had criticized the economic practices, intellectual abilities, and political behavior of women while emphasizing the importance of female domesticity in national development. These histories had created a narrative of exclusion that legitimated the variety of citizenship considered suitable for women, which they argued should be constructed in a very different way from that of men: women's relationship to the nation should be considered in terms of their participation in civil society and the domestic realm. But the throes of the Revolution and the emergence of the first woman's rights movement challenged the dominance of that narrative and complicated the history writers' interpretation of women's history and the idea of domestic citizenship.

In Citizenship and the Origins of Women's History in the United States, Teresa Anne Murphy traces the evolution of women's history from the late eighteenth century to the time of the Civil War, demonstrating that competing ideas of women's citizenship had a central role in the ways those histories were constructed. This intellectual history examines the concept of domestic citizenship that was promoted in the popular writing of Sarah Josepha Hale and Elizabeth Ellet and follows the threads that link them to later history writers, such as Lydia Maria Child and Carolyn Dall, who challenged those narratives and laid the groundwork for advancing a more progressive woman's rights agenda. As woman's rights activists recognized, citizenship encompassed activities that ranged far beyond specific legal rights for women to their broader terms of inclusion in society, the economy, and government. Citizenship and the Origins of Women's History in the United States demonstrates that citizenship is at the heart of women's history and, consequently, that women's history is the history of nations.
A few blurbs:
"Teresa Anne Murphy's fascinating and important book not only reshapes our understanding of the field of women's history but is a valuable contribution to the historical literature on the political, civil, and intellectual status of women in the revolution and early republic."—Carol Faulkner, Syracuse University

"This thoughtful and stimulating intellectual history takes a fresh look at history writing by and about women between the American Revolution and Civil War. It makes an original and distinctive contribution by connecting changing narratives about women's history to larger debates about the nature of women's citizenship."—Anne M. Boylan, University of Delaware

Price deflation and increasing unemployment in Australia

Two years ago we wrote a paper on price inflation and unemployment in Australia. It allowed us making a projection into 2050:

“As a final remark on the evolution inflation (DGDP) and unemployment in Australia we present two predictions as based on the labour force projection provided by the Productivity Commission (2005) and the coefficients in (7) and (8) estimated for the period after 1994: a1=3.299, a2=-0.0259; b1=-2.08, b2=0.0979. We assume that there will be no change in the definitions of all involved macroeconomic variables through 2050 and these coefficients will hold.  Unfortunately, the accuracy of labour force projection has a poor historical record, taking into account the projection between 1999 and 2016. Nevertheless, it may be useful for assessment of the long-term evolution.  Figure 15 displays both predictions, with the period before 2010 represented by actual labour force measurements since the projected ones were not accurate.

Figure 15. Prediction of inflation and unemployment in Australia through 2050 as based on the labour force projection provided by the Productivity Commission.

The level of price inflation after 2015 will likely fall below zero and will remain at -1.5% per year through 2050. This lengthy period of deflation will be accompanied by an elevated rate of unemployment approaching 9% around 2030. The evolution of both variables is not fortunate for the Australian economy and is chiefly associated with the population ageing. The latter suppresses demographic growth and reduces the rate of participation in labour force. Australia will likely need a larger international migration to overcome deflation and high unemployment. This is the means to overcome deflation the U.S. has been using for many years, but even with a large positive migration the Australian economy will be on the brink of deflation during the next four decades. Without migration, Australia will soon join Japan having the same demographic problems and price deflation since the late 1990s.”

Here, we update our projections with three new readings for 2010 through 2012. (We have borrowed all estimates from the Australia Bureau of Statistics.) The Australian economy is heading into a long deflation period with an elevated unemployment. In 2013, the rate of unemployment will rise to 6.5% or even 7.0%. The GDP deflator will likely be negative in 2013 following the 2012 trend.

The reason behind these processes is the same as in Japan – the fall in labor force.
