New Release: Onwuachi-Willig, "According to Our Hearts: Rhinelander v. Rhinelander and the Law of the Multiracial Family"

New from Yale University Press: Angela Onwuachi-Willig, According to Our Hearts: Rhinelander v. Rhinelander and the Law of the Multiracial Family (2013). Here's the Press's description:
This landmark book looks at what it means to be a multiracial couple in the United States today. According to Our Hearts begins with a look back at a 1925 case in which a two-month marriage ends with a man suing his wife for misrepresentation of her race, and shows how our society has yet to come to terms with interracial marriage. Angela Onwuachi-Willig examines the issue by drawing from a variety of sources, including her own experiences. She argues that housing law, family law, and employment law fail, in important ways, to protect multiracial couples. In a society in which marriage is used to give, withhold, and take away status—in the workplace and elsewhere—she says interracial couples are at a disadvantage, which is only exacerbated by current law.
One of of the blurbs on the book's webpage comes from our very own Tomiko Brown-Nagin:
"According to Our Hearts is a fascinating—and sobering—account of interracial relationships in America. Onwauchi-Willig persuasively argues that the “mono-racial” family remains the social and legal standard by which all others are measured. Anyone interested in race, gender and the law will find the book an absorbing and enlightening read."
More information is available here. It looks like excerpts and the TOC will be available soon.

Lyrics: Aly & Fila ft. Sue McLaren - Quiet Storm

Quiet Storm
Aly & Fila ft. Sue McLaren

I've got a long way to go
Down this desert road
Heat will dry me out
'Til i thirst for more

Who knows when you will return
Mirage of oases form
Who knows when you will return
Oh how I long the quiet storm

I've got a long way to go
'Til I beat this thing
Silence drowns me out
Til I'm sinking in

Who knows when you will return
Mirage of oases form
Who knows when you will return
Oh how I long the quiet storm

I've got a long way to go
Who knows when you will return
Mirage of oases form
Who knows when you will return
Oh how I long the quiet storm

I'll Follow
John O'Callaghan ft. Ria

Dark lines they took me far from the dream I once knew,
But now your beauty leads me back to the way from which I flew...

Skies may fall as we crawl into light,
I'll be right here,
And all must die, but this I know,
If you run I'll follow...

Paternity Flute

Two local events taking place today worth knowing about...

Firstly, Lewisham Dads is hosting a party today, starting at 12.30pm. Jane writes:

The fun day is taking place at Ashmead Primary School, SE8 4DX on Saturday from 12.30 - 4.00 and is totally free. No entry cost or charge for activities (unlike most school fairs/fayres), the only cost to families would be food (delicious BBQ and cake stall run by our PTA) and a raffle which has some great prizes including Millwall and Charlton signed kit, footballs etc and a selection of brand new kids bikes amongst other things.

Other activities include bouncy castles, bow and arrow making workshops (!), Under 5s messy play room, cycling activities, Giant Scalextric and information stalls from Lewisham Libraries, Children's Services and the Pre-School Learning Alliance.

Secondly, Brockley orchestra Harmony Sinfonia is staging a concert this evening:

Checkerboard Cake for Birthday

AlongRiz bought a checkerboard cake pans from USA for me a year ago which had not been used and therefore gave me an immediate solution without having to think too much of choice of cake.

  • Although it sounds more in Property than Legal History, but Rick Hills's penetrating post on the Supreme Court's recent exaction decision explains a great deal about the Supreme Court's attempt to police local land use decision since the 1980s (with a look back to the early twentieth century).

No-Bake Cheesecake Flag Cake – Let Your Fruit Flag Fly!

I’ve been avoiding doing a no-bake cheesecake recipe, despite the many food wishes for it, simply because I love the dense, rich texture of the traditional baked version so much that it seems almost a crime to do something like this instead.

That’s a silly attitude, as these are two entirely different desserts, and since I needed a white canvas on which to demo the fruity, 4th of July flag design seen herein, I decided to go for it. The fact that we just had our first real heat wave of the summer didn’t hurt either.

That you can make this lovely, sweet treat without turning on the oven is probably enough of a reason to give this serious consideration. Besides the taste and texture, I think your guests will enjoy the iconic stars and stripes design provided by the fresh blueberries and strawberries.

Everyone knows that if you eat enough fresh fruit with a dessert, it cancels out the negative effects from the sugar and the fat, or at least that’s what I’ve always assumed. Anyway, there is no greater tribute an American cook can pay to this great democracy of ours, than to make a shortcut dessert that looks like our flag. USA! USA! USA! I hope you give this a try soon. Enjoy!

Ingredients for 12 portions:
For the crust:
1 1/2 cups finely crushed graham cracker crumbs
6 tbsp melted butter
1/4 cup white sugar
2 tbsp unsweetened cocoa powder
For the filling:
2 cups (1 pound) cream cheese (I used half regular and half mascarpone)
2 tsp grated lemon zest
2 tsp lemon juice
1 tsp vanilla extract
1 1/4 cups cold heavy whipping cream (36% fat)
1/3 cup white sugar

Best sangria recipe

Welcome to Friday, whoot! Hope your week was great and you have an even better weekend planned!

First up, I’m over at SAS Interiors today sharing how I strive to create a meaningful home:

CreatingaMeaningfulHome_BlogButton

It’s a great series with some fabulous bloggers contributing – check it out! Thanks for having me Jenna!

So today I’m sharing one of my very favorite recipes…of the liquid kind. :) I figured I’d post it today so maybe you can make it yourselves and toast to the weekend, yes?

Aw yeah.

So a lovely reader shared this sangria with me years ago – I needed a good one for an event coming up and sent out the call on Twitter. I’ve tried a lot of sangria in my day (well not a LOT, but a few…you know. Whatever.) and it’s hard to find one that has the right amount of sweet and fruitiness.

Here’s the thing – the initial cost of the ingredients is a little expensive. The liquor needed is about 20 bucks and then you’ll need to buy a few things to make it each time (most of which we already have). But the expensive stuff will last you a really really long time – so over time it’s not too crazy bad.

Here’s what you’ll need:

classic sangria recipe

1 1/2 cup orange juice
2 tbsp triple sec
1/2 cup brandy
1 bottle (750 ml) fruity red wine (the cheaper, the sweeter, the better) :)
3 tbsp sugar
2-3 cinnamon sticks
lemon/orange/lime or even strawberry, pineapple, whatever!
1 1/2 cup chilled lemon/lime sparkling water

You’ll want to mix the first six ingredients (hold off on the lemon/lime water) and stir. Next up, cut the fruit into slices:

classic sangria recipe

One of the reasons I love this drink is because it’s such a pretty one to serve. :)

Just make sure to clean the fruit well before slicing since you will be adding it to the drink:

classic sangria recipe

Side note – we like our orange juice with pulp. Usually I make this with OJ without it (it’s clearer) but I was using what we had this time.

This is where I like to let it steep in the fridge for a while – preferably over night. But it is still super delicious right away too. My sister-in-law had some right after I mixed it last night and it was yummy, but letting it sit really deepens the flavor.

Right before you serve it (after letting it steep for awhile or right after mixing everything), add the lemon lime sparkling water – this is what gives it a slight fizz. So good!

I make this for every party or girl’s night and it’s always a hit. My SIL and I were reminiscing tonight how my father-in-law loved sangria and would always order it when we went out to new restaurants. Thing is he would always turn up his nose after trying it and it made us laugh every time – he could never find one that was just right.

But I’m proud to say he LOVED my sangria. ;)

Hope you’ll try it and love it too!: best sangria recipe

Have a great weekend, cheers!

O'Connor, "Taking, Tort, or Crown Right?"

Sean M. O'Connor, University of Washington School of Law, has posted Taking, Tort, or Crown Right? The Confused Early History of Government Patent Policy, which appeared in the John Marshall Review of Intellectual Property Law 12 (2012): 145-204.  Here is the abstract:
From the early days of the Republic, Congress and the federal courts grappled with the government’s rights to own or use patents it issued. Courts rejected the British "Crown Rights" rule that allowed the sovereign to practice whatever patents it issued. Instead, the federal government was conceptualized as a legal person on par with any other persons with regard to issued patents. But, this simple rule presented challenges as complexities arose in three intertwined patent rights scenarios. The first involved inventions by government employees. The second revolved around government and government contractor use of patents held by private citizens. And the third involved inventions by federal contractors and their employees arising under federal funding. While these three scenarios seem quite distinct today, nineteenth and early twentieth century courts often treated them as overlapping. The confusion was not resolved until the mid-twentieth century when a combination of executive branch and Congressional legislation set the roots of current government patent policy. This Article reviews the history in detail and illuminates current government patent policy debate occurring through such seemingly diverse cases as Stanford v. Roche and Zoltek Corp. v. United States.

The Other Art Club at The Talbot

Friend of BC, Sarah writes:

Every Wednesday the upstairs dining room at the Talbot transforms into The Other Art Club: a new life drawing class, taught by local artist Perienne Christian. Lured by the promise of free cava, I turned up for the launch night and had so much fun that I returned the following week.

Beginning with a series of short poses, the first half of the class is a warm up, designed to engage the parts of the brain that office jobs don't reach. Perienne suggests exercises and circulates unobtrusively, leaving you to do your own thing if you prefer. Half-time refreshments come in the form of home-baked biscuits and a nice cup of tea (or something stronger from the bar downstairs).

These are billed as life drawing classes with narrative - this really kicks in with the second half of the class. Last week's model took on a despairing pose based on a Titian masterpiece. As an absolute beginner, I was concentrating on giving her the right number of limbs, but I can see how the props would add an element of challenge for people with a bit more talent or experience. Perienne's on hand throughout and at the end of the session there's a chance to compare your efforts in a friendly, supportive atmosphere.

Venue: Upstairs at the Talbot
Time: Wednesdays 4-6pm and 7-9pm
Cost £14 in advance (first class half price)
Charcoal provided, paper available at cost price

Lyrics: Tiƫsto ft. Charlotte Martin - Sweet Things

Classic Fridays:
Sweet Things
Tiƫsto ft. Charlotte Martin

Build me a bridge
Burn me a fire
Rest something in my empty hands
Fill it with light
Fill me tonight
I figured that you would understand

Up until dawn
Sweat on your palms
Feeling you poor me in out in
Under again
Under my skin
Guiding me through this hall of fears

Sweet things build on these
Sweet things build on me
Sweet things build on these
Sweet things bring to me

Sing in my head
Omnipotent
Circling momentum round and round
Quenching my thirst
First for my thought
Second to fill my silent mouth

Sweet things build on these
Sweet things build on me
Sweet things build on these
Sweet things bring to me

Sweet things build on these
Sweet things build on me
Sweet things build on these
Sweet things bring to me

Young Americans Oppose Internet Sales Tax

In a recent Gallup poll, the majority of Americans (57%) say they would vote against a law that would allow each state to collect sales taxes on purchases its residents make online over the Internet. Young adults (73%) voice the most widespread opposition to such a law.

The Senate passed an Internet sales tax bill, the Marketplace Fairness Act, last month on a bipartisan basis, but it has yet to pass the House. This legislation would allow states to require online sellers to collect sales taxes, which would go to state and local governments. The legislation would apply to online retailers earning at least $1 million in sales outside of states where they have brick-and-mortar locations. Currently, online retailers do not have to collect sales taxes on Internet purchases unless they have a physical presence in the state.
This legislation faces more opposition in the House than it did in the Senate, with numerous members, including House Speaker John Boehner, criticizing it. The White House has announced that the president supports the legislation.
Age largely shapes Americans' views on taxing Internet sales. Younger Americans are much more likely than older Americans to oppose such a law. If Republicans in the House oppose the Internet sales tax bill, that may help the GOP's appeal to younger Americans, a key demographic in the party's plans to build support before the 2014 and 2016 elections.

Brockley Rise built on ancient Indian burial ground

For those who missed the excitement on Twitter earlier, a large hole opened up in the road in Brockley Rise this afternoon. Police are looking into it (with thanks to Dave "Mike" Lowry for the joke, as well as the picture).

Lewisham Way witness sought

Police at Lewisham are appealing for witnesses to a robbery that occurred on 18 June 2013 at approximately 22:00 hours outside the Albertines Public House in Lewisham Way, SE4.

A woman in her 40s was assaulted by two women who took a number of items from her including cash before making off.  Two women both 21 years have been arrested in connection with the incident and have been bailed pending further enquiries

Officers are particularly keen to speak with a customer who was inside the pub at the time and is believed to have witnessed the assault but is yet to make contact with police.

If you have any information on this incident please contact Brockley Safer Neighbourhoods Team on 0208 284 8558 or if you want to provide information anonymously you can contact Crimestoppers on 0800 555 111.
